This application is for grant of regular bail in connection with Bhaptiyahi P.S.Case No.11 of 2019 for the offences under Sections 302, 201/34 of the Indian Penal Code. As per the FIR, son of the informant had gone along with his friends and later on his friends informed the informant that his son was caught by the petitioners and taken inside the house and he was brutally assaulted and on that information the informant went there but did not find his son thereafter he called the police and the police on interrogation of the petitioners found the dead body near the Canal cancealed in the sand having severe injuries on his body.

No.54724 of 2019(4) dt.06-02-2020 2/2 Submission of the learned counsel for the petitioners is that there is no eye witness to the occurrence and though his friends have not been examined by the police . Heard learned A.P.P. and perused para nos. 13 and 14, who are the persons accompanying the deceased to the house of the petitioners and have also supported the allegation of assault by these petitioners ..
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner .
With the above direction, this application is dismissed.
