JUSTICE SATYAVRAT VERMA ORAL ORDER 11-02-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with C-1. Case No.168 of 2021, instituted for the offences under Sections 30(a), 56 (b) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 22.09.2021, he is a person with clean antecedent and prosecution report has been submitted in the case.

Allegation is of recovery of 178.200 litre of liquor from a Scorpio vehicle. The petitioner is alleged to be the driver. The learned counsel for the petitioner submits that petitioner, being the driver of the vehicle, was not aware what

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and prosecution report has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Purnea in connection with C-1. Case No.168 of 2021.

The application stands allowed.
