2. The petitioner is apprehending his arrest in connection with Andhramath P.S. Case No. 86 of 2024, F.I.R. dated 21.05.2024 for the offences punishable under Sections 8, 20(b) (ii) (c) and 25 of the NDPS Act.
3. Recovery is of 60 kg of Ganja.
4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R.
5. The learned Additional Public Prosecutor has
Patna High Court CR. MISC. No.65585 of 2024(2) dt.05-10-2024 2/2 vehemently opposed the prayer for bail of the petitioner and submits that altogether 60 kg of contraband/Ganja has been recovered from the mill of the petitioner and the recovered contraband is more than the commercial quantity.
6. Considering the aforesaid facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Andhramath P.S. Case No. 86 of 2024 pending in the court of Sessions Judge, Madhubani.
7. Prayer is refused.
