JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 147, 354(A), 504 and 506 of the Indian Penal Code. Petitioners are named in the first information report but no specific overt act has been attributed against them except against the petitioner no.2, who is said to have ordered the others to assault the informant. So far as the allegation of calling Witch to the informant is concerned, the same appears to be omnibus in nature.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition

Patna High Court Cr.Misc. No.68594 of 2018(2) dt.13-12-2018 2/2 is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Birpur, Supaul in Kunauli P.S Case No. 35 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
