2. The petitioner seeks bail in connection with Pakridayal P.S. Case No. 122 of 2022 registered for the offence under Sections 147, 148, 149, 447, 341, 342, 302, 307, 324, 325, 323, 326, 120(B), 504 and 506 of IPC.
3. The petitioner is named in the F.I.R. and is in custody since 30.05.2025.
4. The allegation against the petitioner is to commit the murder of the husband of the informant due to longstanding land disputes.
5. Learned counsel appearing on behalf of the petitioner submitted that the allegation against petitioner is

No.54950 of 2025(2) dt.05-12-2025 2/3 very much general and omnibus, whereas the allegation, as regard to fatal assault, is available against Siyaram Singh and Dharmendra Singh. It is submitted that both parties are agnate and a title suit regarding land dispute is pending between the parties, which is the main cause of present occurrence. It is further submitted that for the same set of occurrence, a counter case was lodged by petitioner side, which was registered as Pakridayal P.S. Case No. 123 of 2022, wherein, 6 persons from petitioner side received grievous injury, suggesting loudly that occurrence is nothing but a free fight. While concluding the argument, it is submitted that petitioner is a man of clean antecedent and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.
6. Learned APP duly assisted by Mr. Rajan Kumar learned counsel for the informant opposes the prayer of bail.
7. In view of aforesaid factual submission and by taking note of fact as regard to assault, is very much general and omnibus against these petitioners, rather the same is

No.54950 of 2025(2) dt.05-12-2025 3/3 specific against other co-accused persons, causing death of the husband of informant, where occurrence appears to be a free fight, coupled with fact that investigation of this case already completed where petitioner remains in custody since 30.05.2025, accordingly petitioner above named, is directed to be released on bail in connection with Pakridayal P.S. Case No. 122 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., East Champaran at Motihari /concerned court, subject to the conditions as mentioned under Section 480(3) of BNSS.
