No doubt, petitioner carries criminal antecedent of near about 5 cases but in the present case, petitioner was neither caught at the spot nor anything was recovered from his conscious possession and name of the petitioner surfaced in this case in course of investigation, when the confessional statement of Kanhaiya Singh was recorded.
