JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

Petitioner seeks bail in connection with Deepnagar P.S. Case No. 221 of 2014 registered for the offences punishable under Section 392 of the Indian Penal Code.

The petitioner is not named in the F.I.R. During investigation his name transpired in the confessional statement of co-accused Ram Ratan Chaudhary and thereafter the petitioner was arrested and he also confessed his guilt and he was not put on T.I.P..

Submission is of false implication and that he has got no criminal antecedent and co-accused Vikash Kumar similarly

Patna High Court Cr.Misc. No.27730 of 2015 (3) dt.14-10-2015 2/2 situated has been allowed bail vide order dated 01.09.2015 passed in Criminal Miscellaneous No. 36937 of 2015 by a co-ordinate Bench of this Court.

Learned A.P.P. is not in a position to distinguish the case of the petitioner from other co-accused. In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial magistrate, Nalanda at Bihar Sharif arising out of Deepnagar P.S. Case No. 221 of 2014 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
