The petitioners seek bail in a case registered for offences under Sections 272 and 273/34 of the Indian Penal Code and Sections 30 (a) and 36 of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 245 bottles of Nepali Saufi liquor each containing 300 ml were recovered from two bags kept on the motorcycle which was being boarded by the petitioners. Petitioners claim that they are having clean antecedent and are in
Patna High Court Cr.Misc. No.53331 of 2017(2) dt.09-11-2017 2/2 custody since 15.07.2017.
Considering the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII-cum-Special Judge, Excise, East Champaran, Motihari in connection with Ghorasahan P.S. Case No. 358 of 2017 with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
