JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Ramkrishna Nagar P.S. Case No. 465 of 2019 registered for the offences punishable under Sections 385, 386, 387, 506, 147, 148, 149 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution story is that informant purchased a piece of land and petitioners came and demanded extortion from her. Submission of learned counsel for the petitioners is that as a matter of fact the land belongs to the petitioners which is a purchased land of the petitioners and with respect to that a proceeding under Section 144 Cr.P.C. is going on and allegation of demand is false and fabricated.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Judge-XIII-cum-Additional Chief Judicial Magistrate, Patna, in connection with Ram Krishna Nagar P.S. Case No. 465 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
