JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be father in law of the deceased. Initially, the case was lodged under Sections 302, 201/34 of the Indian Penal Code but after investigation, police submitted charge sheet under Sections 306, 201/34 of the Indian Penal Code which is evident from perusal of para-62 of the case diary. Moreover, at para-8 of the case diary, the statement of daughter of deceased has been recorded and she stated that on the alleged date of occurrence, a quarrel took place between the petitioner and deceased and petitioner assaulted the deceased with fists and slaps and after that deceased committed suicide but when the deceased engulfed in fire, petitioner and others tried to save

Patna High Court Cr.Misc. No.17288 of 2015 (5) dt.15-10-2015 2/2 the life of the deceased and deceased was brought to hospital but unfortunately, she died in course of her treatment. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Konch P.S. Case No. 133 of 2014.
