ANJANA MISHRA ORAL ORDER 17-11-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Bahera P.S. Case No.519 of 2014 (G.R. No.526 of 2014)for allegedly having committed the offences under Sections 147, 148, 149, 341, 323, 308, 504, 506 and 435 of the Indian Penal Code.

Learned counsel for the petitioners submits that though there is a case and counter case between the parties, the injuries purported to have been inflicted by these petitioners

Patna High Court Cr.Misc. No.47241 of 2016 (2) dt.17-11-2016 2/2 have been found to be simple in nature. It is further submitted that the main allegation is against other accused, namely, Dilip Yadav and Raj Kishore Yadav, but at the time of submission of the chargesheet, these two accused have not been sent up for trial. However, cognizance has been taken against the present petitioners.

Considering the entire facts and circumstances and that the injuries have been found to be simple in nature, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipur, Darbhanga,, in connection with Bahera P.S. Case No.519 of 2014 (G.R. No.526 of 2014), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
