JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 14.08.2013 in a case in which charge has been framed under section 307 and other minor sections of the Indian Penal Code.

The accusation against the petitioner is that he gave one hammer blow causing grievous injury on the head of the informant.

The trial court has reported that petitioner was charged on 16.05.2014 and subsequently, one co-accused was charged on 30.07.2015. It has also been reported that only one prosecution witness has been examined and the case is pending for examination of rest of the prosecution witnesses.

No.31332 of 2015 (3) dt.15-10-2015 2/2 Taking note of the aforesaid facts as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional District Judge, Araria in connection with Session Trial No. 234 of 2014 arising out of Araria P.S.Case No. 313 of 2013.
