JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Nautan P.S. Case No. 27 of 2016 registered for the offences punishable under Sections 341, 323, 325, 379, 427, 376, 511/34 of the Indian Penal Code and Sections 6, 8 of POCSO Act. It would appear from perusal of the first information report that it was co-accused, Bharat Singh, who made attempt to outrage the modesty of informant. So far as petitioners are concerned, it is only alleged that after the above stated occurrence they along with main accused went to the house of the informant and threatened her family members not to lodge the case.
Patna High Court Cr.Misc. No.42671 of 2016 (2) dt.22-11-2016 2/2 Moreover, co-accused, Bharat Singh has already been granted privilege of bail by this court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Nautan P.S. Case No. 27 of 2016 subject to condition as laid down under Section 438(2) of the Cr.P.C.
