JUSTICE BIRENDRA KUMAR ORAL ORDER 15-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Mahua P.S. Case No.95 of 2017, a case under Sections 25(1b)a/26/35 of the Arms Act as well as Section 8/20(b)(ii)(c) of the N.D.P.S. Act.

The police is informant of this case. The F.I.R. relates to recovery of fire-arm and narcotic drugs. Submission of the learned counsel for the petitioner is that a country-made loaded pistol is said to have recovered from the possession of the petitioner. Petitioner is in custody since 12.04.2017. No narcotic was recovered from the possession of the petitioner.

No.60262 of 2017 (4) dt.15-02-2018 P2/ Further submission is that though the petitioner is accused in several cases, however, the petitioner has detailed that in most of the cases the F.I.R. is against unknown and the same police officer of same police station had remanded the petitioner in each and every case.

Considering the nature of allegation and the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
