====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 07-04-2025 Heard learned counsel for the petitioners and learned counsel for the Bihar Engineering University.
2. The present writ petition has been filed for following reliefs:
(i) For issuance of an order, direction or a writ of mandamus for directing the respondent authorities to enable the writ petitioners to
Patna High Court CWJC No.12373 of 2024(5) dt.07-04-2025 2/3 participate in 3rd, 4th and 5th semester examination along with the junior batch of 2022-26 session and for a further direction upon the respondent authorities to allow the petitioners to attend the classes of the 6th semester along with their own batch of 2021-2025 and allow them to participate in the end semester examination thereof subject to them clearing the backlog papers.
(ii) For issuance of an order, direction or writ of mandamus for directing the respondents to ensure that the petitioners are allowed an opportunity of clearing the 3rd, 4th and 5th semester examination either along with the junior batch or by arranging a special examination in order to ensure that they do not suffer one year back in their academic session.
3. At this stage, learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the respondent authorities for redressal of their grievances. Liberty, so sought, is granted.
4. Learned counsel for the University has no objection.
5. Considering the reliefs sought by the petitioners, the petitioners are directed to file a detailed representation before the respondent no.3 (The Registrar Bihar Engineering
Patna High Court CWJC No.12373 of 2024(5) dt.07-04-2025 3/3 University, 6th Floor Examination Block, AKU Campus, Mitthapur, Patna) along with all supporting documents within a period of four weeks and the respondent no. 3 is well advised to consider the case of the petitioners after affording opportunity of personal hearing or through their counsel and pass a reasoned and speaking order in accordance with law within six weeks thereafter.
6. It is made clear that the respondent no.3 shall be liable for non-compliance of this order within the stipulated period.
7. With the aforesaid direction, the writ application stands disposed of.
