JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-10-2015 Heard the learned counsel for the petitioner, the learned A.P.P as also learned counsel for the Informant. The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 06.03.2014 vide Cr. Misc. No. 50747 of 2013 on the ground that the petitioner is suffering in custody since 13.08.2013 and from perusal of paragraph-3 of the case diary it reveals that the injured Md. Raquib was not in a position to give his statement and further the doctor has found his thumb brunt. Abdul Salam in whose vehicle the deceased was brought has also not stated that the injured stated the name of the petitioner rather his father was taking the name and there is land dispute and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. duly

Patna High Court Cr.Misc. No.27986 of 2015 (3) dt.15-10-2015 2/2 assisted by the learned counsel for the informant opposes prayer for bail by submitting that the co-accused sprinkled patrol over the body of Md Raquib and the petitioner ignited and the Sessions Trial is fixed for argument.

In the facts and circumstances as stated above, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail is hereby rejected in connection with Sessions Trial No. 65 of 2014 arising out of Garaul (Kathara O.P) P.S. Case No. 264 of 2013 pending in the court of 1st Additional Sessions Judge, Hajipur, Vaishali. (Jitendra Mohan Sharma, J) Abhay/- U T
