JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act 2016.

The written report of the informant reflects that the alleged recovery of foreign liquor was made from narrow lane behind hotel Galaxy and the name of petitioner and one F.I.R named accused was disclosed by confediential sources of the police. It appears that except the aforesaid material, there is nothing against the petitioner.

No doubt, earlier one case of similar nature was lodged against the petitioner in the year 2018 but the present

Patna High Court Cr.Misc. No.64490 of 2018(2) dt.12-12-2018 2/2 case was also lodged in the year 2018.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 2nd, cum Special Judge, Nawada in C.I.S No. 812 of 2018 arsing out of Nawada Town P.S.Case No. 541 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
