3. In view of the fact that the application has been filed seeking restoration of CWJC No. 11466 of 2010, the Court has taken up the matter on merits.

4. After hearing learned counsel for the petitioner and learned counsel for the State and going through the averments

Patna High Court MJC No.3178 of 2019(2) dt.28-08-2019 2/2 made in the application, the Court finds that there is no willful or deliberate laches on the part of the petitioner due to which the writ petition was dismissed for non appearance.

5. In view thereof, the order dated 28.02.2017 passed in CWJC No. 11466 of 2010, stands recalled.

6. Accordingly, CWJC No. 11466 of 2010, stands restored to its original file and number.

7. The application stands allowed subject to the defects being removed today.
