JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner as well as learned APP.
On getting confidential information, a raid was conducted at the betal shop of petitioner wherefrom, petitioner along with others were apprehended. During course of search, computer, key board, mouse, dongle, card reader and printer etc were seized along with documents and cash appertaining to Rs. 53495/-.
The aforesaid raid was conducted after having confidential information regarding preparation of forged and fabricated bills at the end of petitioner in order to give illegal gain to the transporters as well as causing loss to the State exchequer concealing the actual valuation of the articles whereupon VAT is being realized.
Patna High Court Cr.Misc. No.31923 of 2015 (3) dt.15-10-2015 During course of investigation saved file having been kept in computer has been down loaded and details thereof have been incorporated. Furthermore, the relevancy of aforesaid list has been verified at the end of Sales Tax Department and that is indicative of the fact that petitioner has got active involvement therein.
In the facts and circumstances of the case, the Sales Tax Department is directed to trace out the concealment of VAT relating to the items down loaded from the computer of the petitioner and on payment of the aforesaid amount at the end of the petitioner, petitioner, Guddu Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Rajauli PS Case No. 109/2015, GR. No. 1455/2015.
For compliance of the instant order, the learned lower court will intimate the Sales Tax Department. (Aditya Kumar Trivedi, J) perwez U T
