The petitioners apprehend their arrest in Katra P.S. Case No. 119 of 2021, registered for the offences punishable under Sections 307, 379, 323 of the Indian Penal Code. Prosecution case in brief is that all the FIR named accused persons including petitioners armed with lathi, danda, iron rod etc. gave iron rod blow on the head of informant and when he tried to save himself his hand got fractured. When sons and daughter-in-law of informant came to rescue they were also assaulted by the accused persons. One of the sons of informant sustained head injury.

Patna High Court CR. MISC. No.66205 of 2021(2) dt.24-05-2022 2/2 It is submitted that there is case and counter case. Both sides sustained injury. Injuries sustained by the informant side have been found to be simple in nature. There is general and omnibus allegation. The dispute arose between the parties over the issue of flowing of water. Petitioners have got clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Muzaffarpur in connection with Katra P.S. Case No. 119 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
