This appeal has been preferred against the order dated 11.06.2025 passed by the learned Additional District & Sessions Judge, 1st -cum-Special Judge (Children Court), Gopalganj, in connection with Special Case No.02 of 2025, arising out of Gopalganj Town P.S. Case No.584 of 2024, by which the prayer of the appellant for grant of regular bail has been rejected.

As per the F.I.R., the appellant and his friends have taken the son of the informant from his house and

Patna High Court CR. APP (SJ) No.3154 of 2025(3) dt.23-09-2025 2/3 after some time the dead-body of the son of the informant was recovered.

It has been submitted by learned counsel for the appellant that after investigation the Police has submitted the Final Form finding the case false against this appellant but the Juvenile Justice Board, Gopalganj differing with the said Final Form has taken cognizance against the petitioner. It has also been submitted that the petitioner is in custody since 17.08.2024 having clean antecedent.

Considering the aforesaid facts and circumstances of the case as well as the period of custody of the appellant, this appeal is allowed.

Accordingly, the order dated 11.06.2025 passed by the learned Additional District & Sessions Judge, 1st - cum-Special Judge (Children Court), Gopalganj, in connection with Special Case No.02 of 2025, arising out of Gopalganj Town P.S. Case No.584 of 2024 is hereby set aside. 7.

Let the appellant, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 1st -cum-Special Judge (Children Court), Gopalganj / concerned Court below in

Patna High Court CR. APP (SJ) No.3154 of 2025(3) dt.23-09-2025 3/3 connection with Special Case No.02 of 2025, arising out of Gopalganj Town P.S. Case No.584 of 2024.
