JUSTICE RAKESH KUMAR ORAL ORDER 03-12-2015 Heard Sri Krishna Prasad Singh, learned senior counsel, who was assisted by Sri Bhaskar Shankar, learned counsel for the petitioner, learned A.P.P. as well as Sri Birendra Kumar Singh, learned counsel, who has voluntarily appeared on behalf of the informant.

The petitioner, who is in custody since 16.8.2015 in connection with Madanpur P.S. Case No. 112 of 2015 registered for the offence under Section 302, 201, 120(B)/34 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by Sri Singh, learned senior counsel for the petitioner, that though petitioner's name has been incorporated in the accused column of the F.I.R., from perusal of the F.I.R. it is evident that only on suspicion petitioner has been

No.52310 of 2015 (2) dt.03-12-2015 2/2 made accused whereas, learned counsel for the informant has opposed the prayer for bail and argued that in a deep rooted conspiracy in the present case murder has taken place and during investigation bank account was also verified which corroborated that amount was paid to the killer.

Keeping in view the nature of accusation, I do not find it a fit case for grant of bail.

The bail petition stands dismissed.
