This application for anticipatory bail arises out of Buxar (Town) P.S. Case No.205 of 2018, disclosing offences under Sections 147, 148,149,307,427,120B of the Indian Penal Code and Sections 25(1-b) a 25(1)A, 26,27,35 of the Arms Act.

Learned Senior counsel appearing on behalf of the petitioner submits that name of this petitioner and some other coaccused persons have cropped up on the basis of disclosure made by co-accused and there is no specific allegation against him. He has submitted that similarly circumstanced co-accused Harendra Kunwar alias Harendra Kumar has been granted anticipatory bail by an order dated 07.08.2018 passed in Cr. Misc. No. 43541 of 2018. My attention has also been drawn to another order dated 25.10.2018

Patna High Court Cr.Misc. No.73018 of 2018(2) dt.19-12-2018 2/2 passed in Cr. Misc. No. 64817 of 2018, whereby similarly circumstanced co-accused persons, namely, Vikki Tiwari and Pintu Singh alias Pintu Kumar Singh have been granted anticipatory bail by this Court.

In view of the above submission, this application is allowed.

Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Buxar (Town) P.S. Case No.205 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
