The petitioner is accused in connection with Phulwari Sharif (Janipur) P.S. Case No. 486 of 2015, registered under Section 414/34 of the Indian Penal Code. The accusation is that co-accused Rahul Kumar @ Ramakant Prasad had been apprehended by the Police and he disclosed the name of the petitioner and others as the persons involved in the theft of the motorcycle. Thereafter, petitioner and one Ajay Kumar was apprehended at the house of the Navin Kumar Sinha, from where two motorcycles were recovered regarding which no valid paper was produced.

No.55222 of 2015 (3) dt.30-01-2016 2/2 petitioner submits that, in fact, the petitioner has been falsely implicated in this case merely on suspicion at the house of Navin Kumar Sinha and he is in custody since 13.07.2015. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Sema Eram, Judicial Magistrate 1st Class, Patna in connection with Phulwarisharif (Janipur) P.S. Case No. 486 of 2015.
