Petitioner is apprehending his arrest in connection with Motihari Town P.S.Case No.366/19 , registered for offences punishable under Section 365 of the Indian Penal Code. Prosecution story is that the co-accused Vinod Kumar Yadav has enticed her daughter away. It has aslo been alleged that the petitioner has hands in that.
Submission of the learned counsel for the petitioner is that FIR itself discloses that she fled away along with Vinod Kumar Yadav as such he has falsely been implicated in this case. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court CR. MISC. No.51809 of 2019(2) dt.20-08-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran , Motihari in connection with Motihari Town P.S.Case No.366 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
