JUSTICE SATYAVRAT VERMA ORAL ORDER 11-02-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Patori P. S. Case No.337 of 2021, instituted for the offences under Sections 272, 273, 414/ 34 of the Indian Penal Code and Section 30(a) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 08.09.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 200 litre of country-made liquor from an auto the petitioner is alleged to be the driver. The learned counsel for the petitioner submits that petitioner, being the driver, was not knowing which passenger

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Samastipur in connection with Patori P. S. Case No.337 of 2021. The application stands allowed.
