2. Petitioner seeks regular bail in connection with Bargaon P.S. Case No. 35 of 2024 dated 13.07.2024 registered for the offences punishable under Sections 191(2), 126(2), 115(2), 118, 109, 125(1), 352, 351(2), 3/5 of the BNS.
3. The main submissions advanced by the petitioner's counsel are that the instant matter relates to attempt to murder, in the FIR altogether 13 persons including the petitioner have been named, against the petitioner there is no specific allegation and even he is not alleged to be carrying any weapon at the time of commission of the alleged occurrence and the main allegation as to causing sword blow to the stomach of the informant's son is against the co-accused Rahulla, which resulted in coming out of
Patna High Court CR. MISC. No.55138 of 2025(2) dt.18-08-2025 2/2 the intestine from the stomach of the victim, as per the allegation. It is lastly submitted that the petitioner has been languishing in jail since 27.03.2025 having fair and clean antecedent and against him the investigation has been completed and there is case and counter case in between both the parties.
4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.
5. Considering the aforesaid submissions and mainly the alleged role of the petitioner in the alleged occurrence and also coupled with the petitioner's fair and clean antecedent completion of investigation against him and his custody period as well as his young age, this court is inclined to release him on bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Bargaon P.S. Case No. 35 of 2024.
