The petitioner seeks bail in a case registered under Sections 302/201/34 of the Indian Penal Code and later on Sections 3(2) (V) of SC/ST was also added.

As per the allegation set out in the first information report, the petitioner was having love affair with the deceased girl and somebody has seen them while meeting each other. Thereafter, allegedly the petitioner threatened that he will abduct her within two days. It is further alleged that from 18.04.2015 the daughter of the informant was not found in her house and on 21.04.2015 her dead body was recovered. Thereafter, the allegation was made against the petitioner and the Birbal Mahaldar

It is contended on behalf of the petitioner that there is nothing except suspicion against the petitioner. During the investigation, nothing has been collected indicating the petitioner's involvement in the crime. Learned counsel submits that co-accused, Birbal Mahaldar has already been granted anticipatory bail by a Bench of this Court vide order dated 24.09.2015 passed in Criminal Miscellaneous No.27193 of 2015. Having regard to the facts and the circumstances of the case, the petitioner, Ravi Rajvanshi is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.K. Sharma, Judicial Magistrate, 1st Class, Katihar in connection with Katihar Muffasil P.S. Case No.45/2015.
