JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Sahebpur Kamal P.S. Case No. 128 of 2017 for the offences punishable under Sections 414 of the Indian Penal Code and 25(1B) a/26/35 of the Arms Act. According to the prosecution case, while the police was conducting search, they apprehended one person, namely, Md. Sabir and upon search he could not give any satisfactory reply with regard to the papers of the motorcycle. Upon enquiry, the said apprehended accused person disclosed that two of his accomplices are present at Hiratol Siwala and are planning to commit some crime. Thereupon, the police conducted a raid at Hiratol Siwal and arrested two persons including the petitioner and
Patna High Court Cr.Misc. No.53473 of 2017 (2) dt.09-11-2017 2/2 from possession of the petitioner, one loaded pistol was recovered. The learned counsel for the petitioner submits that the petitioner has a clean antecedent, he is in custody since 17.05.2017 and the other accused person has already been granted bail.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Begusarai in connection with Sahebpur Kamal P.S.
