JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Bihta P.S. Case No. 672 of 2014 registered for the offences punishable under Sections 341, 147, 323, 307, 379, 354, 337 of the Indian Penal Code and Section 27 of the Arms Act. For discharging drain water, the petitioner and others named in the FIR assaulted the informant, his wife and other family members and the petitioner caused injury on the head of the informant.

Submission is that there is case and counter case, the parties have entered into compromise, injuries caused to the informant are found to be simple in nature caused by hard blunt

Patna High Court Cr.Misc. No.43300 of 2014 (2) dt.20-03-2015 substance, and as such, the petitioner deserves sympathetic consideration to which the learned APP opposes. Considering that the injuries are simple in nature caused by hard blunt substance, the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, Danapur in connection with Bihta P.S. Case No. 672 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
