Petitioner is not named in the first information report but near about after five years of the occurrence, the statement of two witnesses was recorded at para-56 and 57 of the supplementary case diary and the aforesaid witnesses stated the name of this petitioner namely, Rajendra Rai @ Bolder Rai making allegation against him that he was engaged in smuggling ganja and except the aforesaid material, there appears to be nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.33544 of 2015 (3) dt.16-10-2015 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 3rd Additional Sessions Judge, Motihari in connection with Piprakothi P.S.Case No. 98 of 2008 ( N.D.P.S.
