The petitioner seeks bail in a case instituted under Sections 272, 273, 414 of the Indian Penal Code and Sections 30(a)/47 of Bihar Prohibition of Liquor and Excise Act, 2016. It is alleged that one 16 wheeler truck, loaded with contraband liquors was brought in village Bathua, where several persons were assembled to carry the cartoons from the said truck. It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.08.2017. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has not been arrested from the spot. His name has come on the confessional statement of co-accused. The petitioner had no knowledge regarding the alleged offence. There is no

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Samastipur/successor court, in connection with Ujiyarpur P.S. Case No.82 of 2017.
