The petitioner seeks bail in a case for the offences punishable under sections 341, 324 and 307 of the I.P.C Allegedly, the petitioner being in drunken condition came with bottle of bear and finding alone gave proposal to the informant to marry with him which was opposed and then the petitioner assaulted with bottle on her right side of head causing injury and further after breaking the bottle tried to pierce the same in her stomach which was saved by her left hand causing injury on the left hand.
Submission is of false implication and that two

No.28787 of 2015 (3) dt.27-10-2015 2/2 injuries have been found on the person of the informant caused by hard and blunt substance which are simple in nature and both the injuries only skin deep and the petitioner is suffering in custody since 09.04.2015. Charge sheet has already been submitted and there is no chance of tampering with the prosecution evidence and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. opposes.
In the facts and circumstances as stated above, considering the injury of the victim and custody of the petitioner now the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Muzaffarpur in Muzaffarpur Town P.S. Case No. 252 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
