2. The accused/petitioner seeks bail in connection with Cyber P.S. Case No.39 of 2025 registered for the offences punishable under Sections 318(2), 318(4), 319(2), 338 and 340(2) of the Bhartiya Nyaya Sanhita, 2023 (for short 'B.N.S.') as well as Sections 66-C and 66-D of the Information and Technology Act.

3. The accused/petitioner is named in the FIR and is in custody since 22.05.2025.

4. As per FIR, the petitioner collected Aadhar card, etc. from informant and others for opening their bank account, which after opening bank account, found involved in

It is submitted by learned counsel appearing for the petitioner that the petitioner is not the recipient of the amount, which alleged to be transferred out of cyber fraud as committed by unknown persons. It is pointed out that as once this petitioner upon request of informant himself keep his Aadhar card for opening of his bank account, on the basis of said suspicion, he was implicated with present occurrence. While concluding argument, it is submitted that investigation of this case is already completed, for which, charge-sheet has been submitted and, as such, there is no chance of tampering with the evidence. The petitioner claimed clean antecedent.

6. Learned APP opposed the prayer for grant of bail to the petitioner.

In view of aforesaid factual submissions and by taking note of fact as save and except suspicion as to collect Aadhar card, etc. from informant, nothing incriminating appears against this petitioner during investigation, coupled with the fact that petitioner, being man of clean antecedent, remains in custody since 22.05.2025, accordingly, the

Case No.39 of 2025, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure (for short 'CrPC')/under Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita (for short 'BNSS').
