Patna High Court Cr.Misc. No.29886 of 2015 (3) dt.27-10-2015 2/3 Patahi P.S. Case No. 112 of 2014 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code and accordingly, both the above stated petitions are being disposed of by this common order.
No one appears in Cr. Misc. No. 29886 of 2015. Accordingly, the aforesaid petition stands dismissed for non-prosecution.
So far as petitioner in Cr. Misc. No. 31926 of 2015 is concerned, he is named in the first information report with allegation that he along with others brought the dead body of the deceased but in course of investigation, it came to light that deceased had sweet relation with the mother and sister of the petitioner and on the allege date of occurrence, he was confined in the house of the petitioner and thereafter, he was assaulted. Subsequently, he died in his house.
Learned counsel for the petitioner submits that cause of death is said to be cardio respiratory failure. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, namely, Bhuwali Rai @ Ramshanker Rai be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub
