JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-06-2023 The present writ petition has been filed seeking the following reliefs:- "1. (a) For issuance of direction to the respondent authorities to remove the illegal encroachment of the private land of the petitioner [Khesra No.1379] upon which the respondent authorities forcefully constructed the brick soling road under "Mukhya Mantri Gali-Nala Pakkikarn consent of the petitioner.

Yojana" without consent of the petitioner.

(b) For issuance of direction to the respondent authorities to remove the illegal encroachment of the Government land/ Public Road [Mauza Maheswara, Khata No. 458, Khesra No.

1374, Than No.194] using by the people of Ramauli & Maheshwara,

Patna High Court CWJC No.14296 of 2022(3) dt.27-06-2023 2/2 Ward No. 9, District: Begusarai, by the hand of one Dilip Kumar @ Dilip Sahni, S/o late Methar Sahni who is the member of ward no.9 has constructed his house.

(c) For issuance of direction to the respondent authorities to set-up a permanent police observation to ensure that no illegal encroachment or illegal means take place in future of the land in question which is the Public Road and appropriate legal action be initiated against him as per law."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, for redressal of the aforesaid grievances.

Liberty so sought is granted.

The writ petition stands dismissed as not pressed.
