11-04-2023 Heard learned counsel for the parties.

The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 427, 387, 504, 506/34 of the Indian Penal Code.

It is alleged that on 26.12.2021 at about 3 PM, while the informant was engaged in constructing boundary wall in his sister's house, this petitioner came there and started assaulting him and his labourers with iron rod and also demanded Rs. 50,00,000/- (Fifty Lacs), as protection money, and damaged the boundary wall.

It is submitted on behalf of petitioner that there is land dispute between the parties. The present case has been lodged only to pressurize the petitioner so that he may give up his right /claim over the land in question. It is further submitted that earlier, the petitioner filed a complaint case, bearing Complaint

Patna High Court CR. MISC. No.62364 of 2022(3) dt.11-04-2023 2/2 Case No. 913(C) of 2012 (Annexure 3) against sister and brother-in-law of the informant and in retaliation, this false and fabricated case has been lodged. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Danapur (Patna) in connection with Danapur P.S. Case No. 913 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
