The petitioner apprehends his arrest in Kashimbazar P.S. case No. 99 of 2016 under Section 47(a) of the Bihar Excise (Amendment) Act, 2016.

The police intercepted two persons, while they were going on a motor cycle, who disclosed their names as Ashok Sahani and Sonu Kumar. Ashok Sahani disclosed the name of the petitioner as one of the persons, who managed to flee away. In pursuance of confession made by Ashok Sahani foreign liquor was recovered from the possession of Shankar Sahni but nothing has been recovered from the possession of the petitioner. It appears that save and except disclosure made by the co-accused, there is no material to show that petitioner was found having liquor in his possession.

No.39959 of 2016 (2) dt.20-09-2016 2/2 Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in Kashimbazar P.S.
