JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-11-2022 The limited prayer of the petitioner in the present case is to direct the Circle Officer, Sahebganj, Muzaffarpur to dispose off the pending encroachment case no. 09 of 2011-12. The learned counsel for the respondent- State submits that in case, the aforesaid encroachment proceeding is still pending, the same shall definitely be taken to its logical conclusion, within a stipulated time frame.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to direct the Circle Officer, Sahebganj, Muzaffarpur to dispose off the pending encroachment case no. 09 of 2011-12, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, within a period of 12 weeks of receipt/ production of a copy of this order.
