JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and five others are named in the first information report with accusation that they mercilessly assaulted the deceased and informant as a result of which deceased died in course of his treatment.

The post mortem report of the deceased reveals that altogether four injuries were found on the person of the deceased and out of the aforesaid injuries, two injuries were found on the head of deceased and the aforesaid head injuries became fatal for him but there is nothing in the case diary to show that petitioner was author of the aforesaid fatal injuries.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.30283 of 2015 (3) dt.29-10-2015 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Marhourah P.S. Case No. 152 of 2014.
