JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Roh P.S. Case No. 97 of 2018 dated 28.08.2018 instituted for the offences under Sections 147, 149, 341, 323, 324, 308, 504 of the Indian Penal Code.

For the act of uploading the photo of the sister of the informant on social media which was suspected to have been done by petitioner No. 1, a protest was made by the informant. This led to physical scuffle between the parties. The learned counsel for the petitioners has submitted that apart from the present case, there is a

Patna High Court Cr.Misc. No.69008 of 2018(2) dt.18-12-2018 2/2 counter version of the occurrence also vide Roh P.S. Case No. 96 of 2018. The petitioner as well as the informant are friends and hail from the same locality.

The injuries suffered on both sides are simple in nature.

Regard being had to the aforesaid facts as also taking into account the clean antecedents of the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Nawada in connection with Roh P.S. Case No. 97 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
