The petitioner seeks bail in S.Tr. No. 57 of 2017/84 of 2019, arising out of Terhagachh P.S. Case No. 49/2016, instituted for offence under Section(s) 302 and 201 of the Indian Penal Code.

It is alleged in the written report that dead body of unknown person was recovered from the place of occurrence lying towards north side of road.

Learned counsel for petitioner has submitted that petitioner is not named in the written report. During course of investigation spy disclosed name of one Sarwar Alam, who was arrested by the police. He disclosed name of this petitioner in his confessional statement.

Patna High Court CR. MISC. No.52121 of 2019(2) dt.26-08-2019 2/2 The other co-accused has already been granted bail by a Co-ordinate Bench of this Court vide order dated 10.05.2017 passed in Cr. Misc. No. 15656/2017.

Petitioner is in custody since 19.06.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Kishanganj, in connection with S.Tr. No. 57 of 2017/84 of 2019, arising out of Terhagachh P.S. Case No. 49/2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
