This application is for grant of regular bail in connection with N.D.P.S. Case No.62 of 2017 arising out of Motihari Town P.S.Case No.502 of 2017 for the offences punishable under Sections 22, 23, 24 and 25 of the NDPS Act. Allegation against the petitioner is about recovery of 01 kg. Charas from the house and from there the petitioner was also arrested.
Submission of the learned counsel for the petitioner is the house does not belong to the petitioner and he has been falsely implicated in this case. He is in custody for about 3 months.
Heard learned A.P.P. also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.52961 of 2017 (2) dt.21-11-2017 2/2 Having heard both sides and in view of fact that 01 kg. charas has been recovered, as such, I am not inclined to grant bail to the petitioner. Hence, the prayer for bail of the petitioner is rejected.
With the aforesaid observation, this application is dismissed.
