The petitioner seeks bail in Kuchaikot P.S. Case No. 205 of 2017 registered under Sections 379, 413 and 414/34 of the Indian Penal Code.

The petitioner along with another accused are said to have stolen Rs. 2,000/- and cheque book of the informant from the dickey of his motorcycle and on giving chase he was apprehended with the aforesaid stolen articles.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. As a matter of fact, he had gone in his relation, but the police caught him on mere suspicion and obtained his signature on blank paper and later on

Patna High Court Cr.Misc. No.50523 of 2017 (2) dt.18-10-2017 2/2 converted the same into seizure list. The allegation levelled against the petitioner is not specific rather omnibus. The petitioner has been languishing in custody since 25.07.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Gopalganj in connection with Kuchaikot P.S. Case No. 205 of 2017.
