JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-08-2019 After some argument, the learned counsel for the petitioner seeks liberty to approach the Circle Officer, Madhepur, District-Madhubani by filing appropriate complaint under the provisions of the Bihar Public Land Encroachment Act, 1956 (hereinafter referred to as the 'Act, 1956). At the juncture, upon instruction, the learned counsel for the petitioner submits that the petitioner has already filed a complaint, however, no action is being taken by the Circle Officer, Madhepur for removal of encroachment over the public

Considering the facts and circumstances of the case, the writ petition stands disposed off as withdrawn with a direction to the Circle Officer, Madhepur/Lakhnour, DistrictMadhubani to take appropriate action against the encroachers over the public land by taking recourse to the provisions of the Act, 1956 in case any encroachment has been made over the public road near house of Respondent No. 9 at village-Ram Chandra (Ward No. 1) P.S. Madhepur, District-Madhubani in Anchal-Madhepura, Mauja-Madhepur, Thana No. 259, Khesra No. 378 and Anchal-Lakhnour, Mauja-Pure, Thana No. 258, Khesra No. 1576 (old), 1236 (New).
