2. The petitioner apprehends arrest in a case registered under Section 30(a) of Bihar Prohibition & Excise Act.

3. As per the prosecution case, 40.425 litres of illicit foreign liquor was recovered under the stairs leading to the terrace from out side the house of the petitioner. It is alleged that the petitioner managed to flee away.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case only on the basis of local politics. Further submission is that petitioner was not present on the spot and he has no concern with the illicit seized liquor. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not

Patna High Court CR. MISC. No.57456 of 2025(2) dt.09-09-2025 2/2 named in the FIR. Petitioner has clean antecedent. Petitioner undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Excise Court-II, Muzaffarpur in connection with Excise P.S. Case No. 817 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.
