JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-10-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Singhwara Police Station Case No. 84 of 2016, disclosing offences under Sections 147, 148, 149, 448, 341, 323, 379, 307 and 504 of the Indian Penal Code. The panchayat election, recently held, is in the background of the occurrence.
It is alleged against petitioner no. 1 that he assaulted the informant with farsa on his head. Agaisnt petitioner no. 2, it is alleged that he, too, caused injury with farsa. As regards petitioner no. 3 is concerned, it is alleged that he gave a blow with sword.
Learned Counsel appearing on behalf of the petitioners has submitted that no injury has been found to

Considering the background in which the First Information Report has been lodged and the submissions, which have been made on behalf of the petitioners, this application is allowed.
Let the petitioners, namely, Hitlal Ram, Manmohan Ram @ Golu Ram and Mithilesh Ram @ Feku Ram, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Darbhanga, in connection with Singhwara Police Station Case No. 84 of 2016, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
