JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is in custody since 2.5.2014 in Rampur P.S. Case No.45/14 for the offences under Sections 364, 120(B), 365, 302, 201/34 of the I.P.C.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that on 14.1.2014 when some persons knocked the door and called the husband of the informant, she saw from her balcony that petitioner along with two co-accused persons was calling her husband and when her husband went out side the door they took her husband away and since then he did not return.

On behalf of the petitioner it has been submitted that that he is in custody since 2.5.2014 and charge sheet has been

From perusal of the F.I.R. it has been indicated that the deceased husband of the informant had not been abducted by the petitioner rather husband of the informant on his own will had left with the petitioner and subsequently he did not return home and on the basis of that it has been suspected by the informant that he might have been done to death by the petitioner. Except the suspicion there is no other evidence to suggest the implication of the petitioner in this case.

It has been submitted on behalf of the State that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Gaya, in Rampur P.S. Case No.45/14.
