The petitioner seeks bail in a case instituted for the offences under Sections 489(A), 489(B), 489(C), 420, 414, 34 of the Indian Penal Code.

The prosecution case in short is that on seeing the police, the accused persons stated fleeing away and on search counterfeit currency was recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.5.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. Counterfeit currency is said to have been recovered from the house of one Dina Nath

Patna High Court CR. MISC. No.55068 of 2019(2) dt.04-09-2019 2/2 Choudhary as per the seizure-list. The petitioner is said to be sitting at the house of the said Dina Nath Choudhary. He had no knowledge regarding the counterfeit notes being kept at the house of Dina Nath Choudhary. He has been made accused due to mistake of fact.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -1st, West Champaran, Bettiah in connection with Bairiya P.S. Case No. 163 of 2019.
