JUSTICE KHATIM REZA ORAL ORDER 08-09-2023 Learned counsel for the petitioner submits that under wrong notion this restoration application has been for restoration of Second Appeal No. 411 of 2017, which has been dismissed in default for non-compliance of order dated 10.04.2023.

2. In fact, defect nos. 2 to 4 in Second Appeal No. 411 of 2017 had already been removed in time. As such, noncompliance of order dated 10.04.2023 does not arise.

3. In such view of the matter, this Court is of the view
